Notification of Written Off Vehicle

The purpose of the Written Off Vehicle Register (WOVR) is to:

  • curtail trade in stolen vehicles by preventing the identifiers of written-off vehicles being used to register a stolen vehicle;
     

  • ensure that repairable written off vehicles undergo a thorough process of inspection and identification;
     

  • ensure that vehicles assessed as being a statutory write off are not re-registered; and
     

  • make information available to prospective buyers about whether a vehicle has previously been written off.

            The WOVR is kept under the Road Transport (General) Act 1999. 

Requirements

The Road Transport (General) Act 1999 places a number of obligations on various persons and organisations in relation to the notification and registration of a written off vehicle.

Notification

Under the Road Transport (General) Regulation 2000, an authorised designated person must notify the Road Transport Authority (RTA) of a vehicle which they have assessed as being a total loss. A total loss means that the vehicle has been damaged and the cost of salvage and repair would be greater than the market value of the vehicle before it was damaged. The extent of the vehicle’s damage will determine if the vehicle is a statutory write off of an economic repairable write off.

Who is an Authorised Designated Person?

An authorised designated person is any person who assesses a vehicle as being a total loss. This will typically be an insurer who assesses the vehicle to be a total loss and writes off the vehicle (anywhere in Australia) in the course of the business carried on by the insurer.

Which Written Off Vehicles Must be Notified?

A vehicle which has been assessed as a total loss must be notified to the RTA if the vehicle is less than 15 years of age and:

·          is a motor vehicle with a Gross Vehicle Mass (GVM) not greater than 4.5 tonnes;

·          is a motorbike;

·          is a caravan; or

·          is a trailer with a GVM not greater than 4.5 tonnes.

The authorised designated person must provide information about the written off vehicle within seven days of making the decision to write off the vehicle. This requirement is an offence provision under the road transport legislation.

How do I Notify the RTA of a Written Off Vehicle?

The authorised designated person must complete a Written Off Vehicle Notification Form and submit the form to:
